In short: we respect copyright. If you believe content on PaletteCSS infringes your rights, send a complete takedown notice to our agent and we’ll respond promptly. If your content was removed by mistake, you can file a counter-notice.

1. Overview

PaletteCSS respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), we will respond promptly to valid claims of copyright infringement reported to our designated agent.

2. A Note on Color & Copyright

Individual colors and color combinations are generally not protected by copyright under U.S. law. As a result, most palettes on PaletteCSS are not eligible for copyright protection. However, if you believe that specific content on the Service (for example, an image, written description, or other creative material) infringes a copyright you own, please use the procedure below.

3. Filing a DMCA Takedown Notice

To file a takedown notice, send a written communication to our designated agent that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work that you claim has been infringed.
  3. Identification of the material on PaletteCSS that you claim is infringing, with enough detail for us to locate it (for example, the exact URL).
  4. Your contact information: full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

We aim to acknowledge and respond to valid DMCA notices within 5 business days.

5. What Happens After We Receive a Notice

Upon receiving a valid notice, we will:

  • Remove or disable access to the allegedly infringing material;
  • Make a reasonable effort to notify the user who submitted the material; and
  • Take appropriate action against repeat infringers where warranted.

We may reject notices that are incomplete, that misidentify the material, or that target content not eligible for copyright protection.

6. Counter-Notice Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may submit a written counter-notice to our designated agent containing all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the U.S., to a judicial district in which PaletteCSS may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we may restore the removed content unless the original complainant files a court action seeking to restrain the allegedly infringing activity.

7. Repeat Infringers

In appropriate circumstances and at our discretion, PaletteCSS will limit or terminate the submission privileges of users who are found to be repeat infringers of copyright.

8. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages — including costs and attorneys’ fees. Please be sure your claim is valid before submitting a notice or counter-notice.
